1. Service Description
LotSat ("we," "us," "our") provides automated land intelligence reports generated from publicly available federal and state data sources including, but not limited to, the USDA Natural Resources Conservation Service, FEMA National Flood Hazard Layer, USGS 3D Elevation Program, US Census Bureau, and Esri World Imagery. Reports are generated using artificial intelligence and data aggregation technology to provide informational summaries about land parcels.
2. Disclaimer of Warranties
LotSat reports are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
LotSat reports do NOT constitute:
- An official FEMA flood determination
- A professional property appraisal
- Licensed insurance advice
- A professional land survey
- Engineering or geotechnical assessment
- Legal or financial advice
We do not guarantee the accuracy, completeness, or timeliness of any information in our reports. Data is sourced from third-party government agencies and may contain errors, omissions, or outdated information beyond our control.
3. Limitation of Liability
To the maximum extent permitted by applicable law, LotSat and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use of or inability to use our services
- Any errors or omissions in report content
- Decisions made based on information in our reports
- Unauthorized access to or alteration of your data
Our total liability for any claim arising from or related to these terms or our services shall not exceed the amount you paid for the specific report giving rise to the claim.
4. Data Accuracy Statement
Our reports aggregate data from multiple government sources. While we strive for accuracy, we cannot guarantee that all data is current or error-free. Flood zone information is derived from FEMA's National Flood Hazard Layer and may not reflect the most recent Letter of Map Amendment (LOMA) or Letter of Map Revision (LOMR) changes. Soil data is sourced from USDA surveys that may not account for recent land modifications. Elevation data is derived from USGS datasets with inherent resolution limitations.
LotSat reports are designed as a starting point in your property analysis. All data, estimates, and assessments should be independently verified through licensed professionals and official sources before making any decisions. For legally binding determinations, always obtain certified assessments from licensed professionals.
5. Refund Policy
We want you to be satisfied with your LotSat report. If you believe your report contains significant data errors or was not delivered as described, please contact our support team within 7 days of purchase at our support page. Refund requests are reviewed on a case-by-case basis.
Refunds are not available for reports that were accurately generated but contain data that does not meet your expectations, as our reports reflect the underlying government data sources.
6. User Responsibilities
By using LotSat, you agree to:
- Use reports for personal informational and planning purposes only
- Not redistribute, resell, or publicly publish report content without written permission
- Consult licensed professionals before making property purchase, construction, or insurance decisions
- Not rely solely on LotSat reports for any legally binding transaction
- Provide accurate address information when requesting reports
7. Intellectual Property
The LotSat name, logo, report format, scoring methodology, and website design are the intellectual property of LotSat. Report content is licensed for personal use by the purchaser only. Government data incorporated into our reports remains in the public domain. Our proprietary analysis, formatting, scoring algorithms, and AI-generated commentary are protected by copyright.
8. Modifications
We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our services after changes constitutes acceptance of the revised terms.
9. Governing Law
These terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms or your use of our services shall be resolved through binding arbitration in accordance with applicable rules.
